PRACTICE
Very few firms in India have a dedicated financial services group; it is complex and requires an in–depth understanding of myriad regulations, necessitating experience in dealing with a number of regulators, each of whom has a different set of established practices and functioning. AZB’s Financial Services team comprises lawyers who specialise in specific regulations and have extensive experience in dealing with specific regulators in India.
We are optimally placed to offer nuanced and specialised advisory services to each heavily regulated client category, going beyond regular compliance work. This, inter alia, includes assistance with setting up operations in India including entry–level strategies, restructurings, new financial product offerings and the development of new products.
We have an established track record of supporting and advising our clients on contentious matters before various governmental and regulatory authorities, which helps us to provide cogent, end–to–end advice. Our dedicated forensics team works with the lawyers to specifically assist our clients with regulatory investigations, enquiries and other proceedings, including insider trading, market manipulations, and so on.
On the transactional side, we assist leading players in some of the most high–value and complex domestic and cross–border M&A (including restructurings) and private equity deals in this sector. Some of these transactions have set precedents for the industry.
The team also spearheads various policy initiatives and maintains a regular interface with regulators for impact assessment of new regulations, regulatory representations on policy and legal changes impacting financial services sector regulation, advising and representing industry groups before financial regulators, and assisting regulators on rule–making through representation on regulatory committees and participating in public consolidation processes.
We proactively ensure our clients stay informed of new regulatory and policy changes with potential impact on their business / operations and how best to navigate them with the least disruption. Our detail–oriented and nuanced approach creates confidence in our ability to deliver qualitative work even in difficult and truncated timelines.
