Waiver of the Right to Raise Objections to an Arbitral Proceeding

The Supreme Court of India in Quippo Construction Equipment Limited v. Janardan Nirman Private Limited[1] held that failure to participate in arbitral proceedings or raise objections thereto, including in relation to the place of arbitration and appointment of the arbitrator, will be considered a deemed waiver of such rights and will preclude the relevant party from raising such objections in subsequent proceedings.
