Update – Draft Telecommunications Right of Way Rules, 2024

Our Partner, Aprajita Rana, Senior Associate, Archana Iyer and Associate, Adishree Singh, share their insights on the Draft Telecommunications Right of Way Rules, 2024 (Draft RoW Rules) released on July 9, 2024, for public consultation by the Department of Telecommunications, Ministry of Communications, Government of India. The Telecommunications Right of Way Rules, 2024 will be notified under the Telecommunications Act, 2023, which was enacted on December 24, 2023, and currently being implemented in phases.

In their analysis, they discuss the salient features of the Draft RoW Rules, including provisions relating to single window clearance for obtaining right of way over public property, streamlined timelines for obtaining permission from public entities, process for right of way over private property, facilitation of open access to common duct and cable corridors, etc.

Building on the existing right of way regime, the Draft RoW Rules appear to simplify processes to facilitate faster deployment of telecommunications infrastructure, to enable a more efficient 5G rollout.
