The Hon’ble High Court of Delhi has settled the legal position on the applicability of the Mutual Agreement Procedure (“MAP”) on non-covered transactions.

In first of its kind ruling, the Hon’ble High Court of Delhi has settled the legal position on the applicability of the Mutual Agreement Procedure (“MAP”) on non-covered transactions. The Hon’ble High Court has held that such transactions not being negotiated, considered and concluded under the MAP, could not be benchmarked on the basis of the settlement reached under MAP by mutual consensus.
