SC Rules that 2018 SRA Amendment on Mandatory Relief of Specific Performance is Retrospective

The SC in Siddamsetty Infra Projects Pvt. Ltd. v. Katta Sujatha Reddy and Ors.,[1] held that the amended Section 10 of the Specific Relief Act, 1963 (amended under the Specific Relief (Amendment) Act, 2018), by which the Court’s power to grant the relief of specific performance is no longer a discretionary remedy, applies retrospectively to all pending proceedings.
