AZB & Partners successfully represented HSBC Mauritius PI Holdings Ltd. in India for enforcing a foreign award. The Supreme Court of India has laid the law re serious allegations of bias raised against leading international arbitrators and its interplay with the “public policy of India” during enforcement of a foreign award by an Indian court. A welcome ruling, as it reinforces the pro-enforcement approach for foreign awards in India and clarifies the law in relation to duty of disclosure of arbitrators vis-à-vis the public policy of India.
