Government of Rajasthan Exempts Shops and Commercial Establishments from Weekly Closure Requirements

The Government of Rajasthan by way of Notification dated May 2, 2024, has notified that shops and commercial establishments registered under the Rajasthan Shops and Commercial Establishments Act, 1958 (‘RSE Act’) are exempted from the applicability of Section 12(1) of the RSE Act (provision on weekly holidays) for a period of three years, subject to inter alia the following conditions:

i.    Employees must be granted one day off per week on a rotation basis;

ii.   A separate record for overtime must be maintained if employees work more than nine hours a day and 48 hours a week;

iii.  Overtime compensation must be paid in accordance with applicable law; and

iv.   All employees must be issued appointment letters.

Any violation of the aforementioned conditions by an employer of any shop or commercial establishment will render this exemption null and void. In such cases, there may be legal consequences for the employers as prescribed under the RSE Act.
