The Haryana State Government notified the Haryana State Employment of Local Candidates Act, 2020 (“Haryana Local Candidates Act”) with effect from January 15, 2022.
The Haryana Local Candidates Act requires private employers to whom the law is applicable to mandatorily employ candidates domiciled in the State of Haryana to fill at least 75% of the positions where the gross monthly salary is up to INR 30,000 (approx. US$ 365). Such private employers are required to register all employees earning gross monthly salary up to INR 30,000 on the designated portal (local.hrylabour.gov.in). This law is applicable to all companies, limited liability partnership firms, partnership firms and any person employing at least 10 persons on salary, wages, or other remuneration for the purpose of manufacturing or providing any service persons.
Recently, through an internal communication, the Haryana Labour Department has instructed its officers to actively encourage private employers to register their eligible employees on the designated portal at the earliest and assist the employers and local candidates by responding to any queries that they may have.
Based on the same, it is likely that the Haryana Labour Department will pursue effective implementation of the Haryana Local Candidates Act.
