Cessation on Invoking Provisions of Disaster Management Act, 2005

By way of an Order dated March 22, 2022, the Ministry of Home Affairs (‘MHA’) has stated that the National Disaster Management Authority, after taking into consideration the overall improvement in the COVID–19 situation in India, has taken a decision that there may not be any further need to invoke the provisions of the Disaster Management Act, 2005 (‘DMA’) for COVID containment measures. Consequently, after the expiry of the existing MHA Order dated February 25, 2022, no new orders may be issued by the MHA. However, the advisories issued by the Ministry of Health and Family Welfare on COVID – 19 containment measures including the use of masks, maintaining social distances, etc., will continue to guide the overall response to the pandemic. Further, the Order instructs all States and Union Territories to consider discontinuing the issuance of Orders and Guidelines under the DMA for COVID – 19 containment measures in an appropriate manner.
