On December 31, 2021, the CCI dismissed a complaint filed by Royal Motors (a dealer of India Yamaha Motor Private Limited) alleging abuse of dominant position by Yamaha Motors Company Limited & others (collectively ‘Yamaha’).[1]
The informant alleged (i) imposition of unfair terms and conditions under the Dealership Agreement by Yamaha; and (ii) appointment of another dealer in the territory the informant operates in thereby denying the informant the sole right of selling Yamaha products in the area.
In its analysis, the CCI noted that the competitors of Yamaha in the motorcycles market in India enjoy higher market shares while Yamaha has a market share of less than 10%. Accordingly, Yamaha was not found to be dominant in the relevant market for ‘manufacture and sale of motorcycles in the territory of India’. Accordingly, the CCI dismissed the complaint.
