CCI Dismisses Allegation of Abuse of Dominance by Mitera Hospital

Parties

The information was filed by Dr. Sabine S., Managing Director, Sabine Hospital and Research Centre Private Limited (‘Informant’) against Mitera Hospital (‘OP’). [1]

Submissions by Informant

The Informant alleged that the: (i) OP uploaded a YouTube video with inaccurate and misleading claims about the cost of fertility treatments, portraying affordable treatments as inferior or hiding hidden cost; and (ii) OP has a dominant position in the market due to its large social media presence, which influenced patients’ choices.

Findings by CCI

The CCI observed that the allegations pertained to misleading information on social media, which does not fall within the scope of the Act.

Since no prima facie case of contravention of the provisions of the Act was made out, the CCI dismissed the matter under Section 26(2) of the Act.
