BHC Refers Question of Appropriate Court for Hearing Application for Extension of Time for Completion of Arbitration Proceedings to Larger Bench

The Bombay High Court (‘BHC’) in Sheela Chowgule v. Vijay V. Chowgule[1], referred the question of whether an application for extension of time for completion of arbitration proceedings lies before the High Court or the Civil Court having original jurisdiction in case of domestic arbitration, to a larger bench as two previous coordinate benches of the High Court had expressed divergent views on this question.[2]
