AZB & Partners successfully represented the Petitioner, who is a former director of Bharti Enterprises (Holdings) Private Limited in the case titled Manik Hiru Jhangiani v. State of Madhya Pradesh, reported at 2023 INSC 1078, before the Hon’ble Supreme Court of India, in quashing of criminal proceedings which was invocated under the Prevention of Food Adulteration Act, 1954, despite the legislature decriminalising certain offences by bringing in a new regime under the Food Safety and Standards Act, 2006. The judgment marks a major development in the sphere of decriminalisation and recognises the guarantee against ex post fact law. This effectuates a course correction at the highest level on legislative changes being accepted as being binding not just on the executive but also the Supreme Court.
