The DOT, has amended the UL Agreement, by way of a Notification no. 20-1333/2022-AS-I dated June 27, 2022, and the unified access service license agreement (‘UASL Agreement’) by way of a Notification no. 20-1333/2022-AS-I dated June 27, 2022, to give effect to the following:
i. Permit surrender and leasing of the spectrum;
ii. Permit a telco licensee to provide captive non-public network (‘CNPN’) services as a part of access services, to enterprises by using network resources over public land mobile network;
iii. Establish isolated CNPN for enterprises using international mobile telecommunication spectrum;
iv. Permit surrender of CNPN spectrum; and
v. Calculation mechanism for gross revenue has been modified to include revenue from permissible leasing of spectrum.
In this context, the DOT has defined CNPN as a terrestrial wireless telecommunication network established for captive use within a specified geographical area, where such networks are restricted from providing commercial telecommunication services.
