Amendment in Companies (Registration of Charges) Rules, 2014

The MCA, by its Notification dated April 27, 2022, has amended the Companies (Registration of Charges) Rules, 2014, which is effective from April 27, 2022. As per this amendment, a banking company will not be required to register or modify any charge with the ROC under Section 77 of the Companies Act, 2013 in favour of the Reserve Bank of India (‘RBI’) when any loan or advance has been made to it by the RBI under Section 17(4)(d) of the RBI Act, 1934, which is an enabling provision, inter alia, permitting the RBI to make available loans or advances to scheduled banks, amongst others, for prescribed tenure and security.
